Terms of Use for the Gratitude App

1. Scope and acceptance
These Terms of Use govern the use of the macOS application Gratitude ("App") provided by Maximilian Otto, Stiftstr. 3, 59555 Lippstadt, Germany ("Provider"). By installing or using the App you accept these Terms. If you do not agree, please do not use the App.
2. Description of the service
Gratitude is a journaling and reflection app. It allows you to create entries, organise them into categories, and optionally receive AI-generated reflection questions and suggestions. Some features may require an in-app purchase.
3. In-app purchases
Certain features of the App are available via in-app purchases. All purchases are processed exclusively through Apple's StoreKit framework; the Provider has no access to your payment details. Prices are displayed in the App before purchase. Purchases are subject to Apple's applicable terms and conditions, including their refund policy. Refund requests must be directed to Apple.
4. AI-generated content
The App may use artificial intelligence (provided by Anthropic) to generate reflection questions and suggestions. Such AI-generated content is provided for inspirational purposes only and does not constitute medical, psychological, therapeutic, or other professional advice. The Provider makes no representations or warranties regarding the accuracy, completeness, or suitability of AI-generated content.
5. User obligations
You agree to use the App only for lawful purposes and in accordance with these Terms. In particular, you shall not:
• reverse-engineer, decompile, or disassemble the App;
• use the App in a way that could damage, overload, or impair the service;
• use automated systems to send more requests to the Provider's server than a human could reasonably produce.
6. Intellectual property
All rights to the App's design, code, and content belong to the Provider unless otherwise stated. You may not reproduce, distribute, or create derivative works without prior written consent.
7. Availability and warranty
The App is provided "as is". The Provider endeavours to keep the App available and free of defects but does not guarantee uninterrupted or error-free operation. Statutory warranty rights under applicable consumer protection law remain unaffected.
8. Limitation of liability
The Provider is liable without limitation for damages arising from intent or gross negligence and for injury to life, body, or health. For slight negligence, the Provider is liable only in the event of a breach of a material contractual obligation (cardinal obligation), and in such cases liability is limited to the foreseeable, typically occurring damage. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected. Any further liability is excluded to the extent permitted by law.
9. Changes to these Terms
The Provider may amend these Terms with reasonable notice. Material changes will be communicated via the App or website. Continued use of the App after the effective date of a change constitutes acceptance of the revised Terms.
10. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer within the EU, mandatory consumer protection provisions of your country of residence apply in addition. The place of jurisdiction is Lippstadt, Germany, to the extent permitted by law.
11. Severability
Should any provision of these Terms be or become invalid or unenforceable, the remaining provisions shall remain in full force and effect.
